Nick Niemann, J.D.
Nick Niemann began his business career helping
his family build, innovate, grow and manage their
various business interests in restaurants, super-
markets, real estate, ranching, farming, construction
and retail merchandising.
Practice. As a Nebraska based Family Business Continuity Attorney, Nick works with business owners around the country. Using the Fourth Quarter Game Plan™ program which he designed and created, he works with business owners and their other trusted advisors to design and implement a specific plan to protect, innovate, grow and transition their companies to their successors. He works with owners to achieve the personal, family, business and financial legacies they want to achieve. His approach also helps preserve and enhance the continuity and growth of business activity and jobs for the community.
Nick has been recognized by Omaha Magazine as the "Face of Business Continuity and Succession Planning."
Experience. Nick has advised business owners for over a third of a century. He is a frequent speaker at national and regional business planning programs for business, industry and professional groups.
He has provided Business Continuity, Succession and Exit Planning guidance for business owners in many business sectors. These include Manufacturing, Business Services, Food & Beverage, Construction, Health Care, Agribusiness, Farm & Ranch, Real Estate, Distribution, Financial Services, Retail, Human Resources, Energy, Transportation, Franchise, Security, Consumer Services, Personal Services, Product Development, Technology Licensing, Leasing, Management and Education.
He has also provided Business Continuity, Succession Planning and Exit Planning guidance for professionals in the fields of CPAs, Financial Planners, Insurance Advisors, Business Consultants, Investment Advisors, Environmental Specialists, Engineers, Attorneys, Architects, Physicians, IT Professionals and Real Estate Developers.
Peer Review. Nick is highly respected within the legal community. He has been selected as "Lawyer of the Year" for Closely Held Companies and Family Business Law (Omaha) by Best Lawyers in America. He has been selected to “Best Lawyers In America” as the first Nebraska attorney named for Closely Held Companies and Family Business Law. He has an AV preeminent rating from the Martindale-Hubbell National Law Directory – Preeminent (5.0 out of 5) (highest peer review rating for legal ability and ethical standards). He has been awarded Lifetime Fellow status by the Nebraska State Bar.
Community. When Nebraska was facing economic stagnation in 1986, the business community and legislative leaders looked to Nick to design a platform for the State of Nebraska to grow business throughout our communities. Nick designed and drafted Nebraska’s game changing business growth legislation. Basing the program on his understanding of company business models, his innovative programs have helped over 850 businesses to achieve long-term, sustainable growth while creating over 100,000 new jobs and $30 billion new capital investment throughout Nebraska. This business growth and business owner succession platform has for over a quarter century continued to help Nebraska businesses to expand effectively exempt from Nebraska income and sales taxes. His programs have also enabled thousands of Nebraska business owners to transition and exit their companies exempt from Nebraska capital gain taxes. This has helped Nebraska to retain many of its top entrepreneurs in Nebraska as active participants in the Nebraska community.
Nick has served on the Headquarters Advisory Group for the Greater Omaha Chamber of Commerce.
Education and Certifications. Nick graduated from Creighton University’s College of Business in 1978, summa cum laude, with a degree in accounting and has a CPA certificate. He received his J.D. from Creighton’s School of Law in Nebraska in 1981, magna cum laude. He has also served on the adjunct faculty of Creighton’s School of Law, teaching transition, succession and exit planning, taxation, business valuation and estate planning.
Family. Nick first learned the ins and outs of business at the heels of his grandfather and father. His grandfather opened his first corner grocery store in 1917. Upon his death in 1969, he had already laid in a transition and succession plan to transfer his growing supermarket chain to Nick’s father and uncle. They continued to operate and grow this business into a successful regional supermarket chain, operating across a variety of supermarket business models, including full service and discount formats (such as Cub Foods, County Market, Save-A-Lot). In 1997, Nick’s father completed his successful transition and exit from Niemann Foods, Inc. and a number of other family businesses.
In 1980 Nick married his college sweetheart, Ann Marie Forbes. They were blessed with their first child in 1981. They have been married for over 37 years and have 7 children and 19 grandchildren.
